GENERAL TERMS AND CONDITIONS OF USE

Our current Terms and Conditions of Use are written in accordance with, and therefore to be interpreted in accordance with, French law.

In the event of any discrepancies between these Terms and Conditions of Use and any translated versions, the French version will set a precedent.

This site is a publication service for dating advertisements and for contact between people aged 18 or over, produced by the company 2 L Multimédia, which is referred to as "our company" in these Terms and Conditions of Use . In these Terms and Conditions of Use, this site is referred to as our "dating service". By becoming a member, you will be able to exchange written messages, chat, etc.

Some features of the site are free to access and others have a cost for members of our dating service. These members purchase unlimited access for a renewable, specified period in the form of a basic subscription, or account options offering access to and use of the service (mobile telephone access, charges for express access, etc.)

1- MEMBER REGISTRATION PROCEDURE

Members of our dating service must be aged 18 or over and must complete all of the mandatory fields as required on the registration forms. A member may also register via a specified site, such as that of one of our partners.

Once the conditions for registration have been fulfilled, each of our members will have the use of one or several username(s) and one or several password(s) in order to use the various different services offered by our company, or one of our selected partners, to which the member has chosen to subscribe. 2 - MODERATION

A - Profile control and content validation

Once subscribed to our dating service, the member's profile is changed to "awaiting validation" by our moderation teams. The member will receive an email containing their account information and informing them of whether their profile has been accepted or rejected. If the profile is rejected, the member will be able to edit their information in order to resubmit their profile to our teams.The validation of a profile may take up to 3 (three) days.

B - General rules regarding photo validation

• Photos which obviously do not represent the member are refused.
• The following photos are refused : animals, children / minors, several people on the same photo, landscapes, "sexy" or bare pictures.
• Photos containing text are not permitted.

We reserve the right to refuse any announcements which seem to contravene the terms and conditions of use.

If these terms and conditions of use are not adhered to, we reserve the right to delete or edit the account of the member concerned, without prior warning or reimbursement in this case.

We reserve the right to vet all or parts of posted messages, so as to remove or withdraw any content that might breach these terms and conditions of use or which might be reprehensible in any other way.

If a member is victim of abuse or harassment, they can warn us by using the link entitled 'report misuse' situated below the profile concerned.

3 - OBLIGATIONS BETWEEN MEMBERS AND THE SERVICE

A - Obligations of the dating service

Our dating services provide a virtual dating service between adults at a distance via digital and electronic communication. As far as exchanges between members are concerned, we provide tools and methods to help each user realise their hopes and expectations by using this site. It is important for members to fill out their profile as much as possible so that others can gain the most accurate idea of their personality.

Our company is not to be held liable for any use of our services, data or information which contravenes the rules found in these terms and conditions of use.

On a technical level, our company undertakes to provide the highest possible quality of service and to ensure that the site contains genuine, active profiles so that each member can benefit from all features of the site, both free and charged, and therefore find as many dates as possible.

Our company cannot guarantee that its services and features are accessible if the member's Internet access provider fails of its own accord.

In order to make full and optimal use of our dating service, members must have an up-to-date version of the software, Adobe Flash Player™ (download at: www.adobe.com).

According to the configuration of the network, access to the internal EasyMessenger™ software may be denied if disabled by a firewall or proxy.

Due to our partnership system, new members of our dating service may be subscribed to another dating site in order to offer them a more comprehensive service and improve their chances of meeting people. At any time, members are free to unsubscribe from any of the sites to which they are subscribed.

4 - Member obligations and cautions

By ticking the box bearing the mention "I am over 18 and have read and accepted the Terms and Conditions of Use", which is situated below the registration confirmation button, and by accepting their subscription, users agree to becoming a member of our dating service. In doing so, you acknowledge that you are fully informed and bound by these conditions, and that you shall undertake to respect our Terms and Conditions of Use.

You must read and accept these terms and conditions of use in order to subscribe to our dating site.

A - Our company requires each user to confirm that he/she:

• Is aged 18 or over.
• Not to use offensive, obscene, discriminatory or violent language.
• Not to use our site for professional or commercial canvassing or to offer meetings in return for payment.
• Will not collect or store personal information originating from other users.
• To provide real data
• To remain correct with the other members.
• Will not request payment for any service.
• Will not promote any other website or service.
• Will not send mass messages regarding personal information (email address, telephone number or advertisements).

If these obligations are not respected, we may impose sanctions ranging from a simple warning to a complete cancellation of a profile, with neither warning nor reimbursement.

B - PRECAUTIONS

When members begin to contact people whom they wish to meet, they must act with caution by:

- Opting for a public space for the first meeting: café, cinema, museum, etc.

- Informing a third party of the time and place of the meeting and, if necessary, being accompanied.

- Not giving out any personal contact details to anyone they have met via our site before getting to know them.

- Not giving out their bank details, in any event.

- Acting with caution around those people requesting a sum of money: never accept.

- Treating overly appealing profiles with caution.

Our company cannot be held responsible in the case of fraud or exploitation of any information which a member communicates to a third party.

If a member doubts whether another member is genuine, or if another member makes indecent proposals, the member can inform us by using the 'report misuse' link which is situated below each profile. We undertake to preserve anonymity in this case.

WE TAKE PARTICULAR CARE TO ENSURE THE QUALITY OF THE PROFILES PRESENT ON OUR SITE We also trust users to report any suspicious profiles.

5 - CONDITIONS FOR ACCESSING OUR DATING SERVICE

A - The charges for the service vary according to several criteria

• For a woman who wants to get in touch with a man the service can be free. Paid services are suggested to women who want to know in detail the members interested in their profile (kiss received, visits and seeking the member)
• Has a cost for women wishing to contact women and/or couples.
• Has a cost for men wishing to contact women, men and/or couples.

6 - TERMS OF AUTOMATIC RENEWAL

A member may get a special offer with discounted price for additional subscriptions

Subscriptions (1 month, 3 months, 6 months and 12 months) are renewable by tacit consent with the same conditions, the special offers are also maintained at these renewals. The subscriber has the ability to stop the tacit consent from the first day of subscription without losing the benefit of it. Indeed, the subscriber is still subscribed until the end of the subscription if he decides to unsubscribe during the period.

A link "Stop my renewal" appears in his account > espace membre > manage my membership and he must follow the procedure up to Step 8 (in order to avoid any dispute,you should stop it at least 48 hours before the renewal of the subscription.)

 

7 - TERMS OF THE REACTIVATION OF THE SUBSCRIPTION BY THE MEMBER

When a member's subscription expires, the member remains on the site but can no longer access the features which require payment. Members have the option of activating their subscription in one click, either by renewing their current subscription or by purchasing and agreeing to a new subscription. Members may either reactivate or purchase a new subscription, by going to "Account" then "Member Space" then "Manage my account".

8 - TERMS FOR ADDITIONAL PURCHASES

A - Additional products

Subscribed members may receive preferential tariffs from other dating services. In this case, it is possible to take out an extra subscription, that is to say an additional purchase within the dating service, in addition to the basic subscription which the member has already purchased. The member will immediately benefit from the extra services provided by the additional service(s) or subscription(s) which have been purchased, according to the conditions displayed within the site on the product and payment pages.

 

9 - REPAYMENT TERMS

A - Terms of reimbursement during the legal period of revocation

In accordance to article L 121-20 of the French consumer code ("Code de la Consommation"), members will be informed that they have 7 (seven) days from the day of their subscription to exercise their right to revocation without penalty or justification. However, according to Article L. 121-20-2, 1 ° of the French Consumer Code, the right of withdrawal can not be exercised once the Member used the services covered by the subscription.

If members wish to delete their profile immediately and no longer benefit from the site's services, they must unsubscribe (Member space > My subscription >, Unsubscribe).

B - Requesting reimbursement outside of the legal period for revocation:

If members wish to be reimbursed for their subscription outside of the revocation period, they must provide evidence proving that they have not used the service. Requests cannot be carried out by telephone. You must send a letter to the legal service at the address found below the Terms and Conditions of Use, including your surname, first name, email address, username and telephone number so that you can be contacted.

Important: after deleting your account, you will no longer be able to make a claim against our company. If you possess a subscription, you must cancel your renewal before deleting your account.

10 - DURATION AND TERMINATION OF YOUR ACCOUNT MEMBER

A - DURATION

Your subscription is continued until you decide to remove your profile. If they have not logged into our dating service for 2 years, information on members is definitively and completely deleted from our databases.

B - termination

Members may end their subscription to our dating service whenever they choose by filing a request with our company for their account to be closed. This will be carried out without charges, apart from those related to sending the request, and without a need for justification, and can be done under "My account" or by any other method indicated in this section.

The cancellation of a subscription by a member takes effect on the date that the current subscription is due to expire, on the condition that the customer files their request at least 48 hours before said date.

Data concerning members is destroyed upon their request or when the current legal periods expire following the cancellation of the member's account. The cancellation of your subscription means your account is deleted entirely, as well as your messages and any personal data which we hold in our possession.

We remind you that after the deletion of your account, you will not be able to make any claim against our company

11 - PRIVACY AND MEMBER DATA PROTECTION

Our company is registered with the French authority for Data Protection (la Commission Nationale de l'Informatique et des Libertés - CNIL) under the number 1403412. We treat the personal data of our members with the uttermost respect, and act in accordance with the standards for privacy and personal data as specified by the French authority (CNIL).

A - Collecting information from members

When registering or purchasing a subscription, members are asked to provide personal information. We are aware that certain "sensitive" information, indications or content provided by members at this point, for which they are responsible, may reveal their ethnic origin, political, philosophical or religious opinions, nationality and/or sexual orientation. By providing this entirely optional information members agree to it being made public and, for all intents and purposes, provide explicit consent to the treatment of this data by the intermediaries of our dating service and its selected partners.

B - Nature and use of the gathered data

Personal datas collected on our dating service can be the member's name, mailing address and / or email address, phone number, bank details, information about his physical appearance, his hometown, age, photos, lifestyle, sexual orientation, religion, interests, personal values ​​and his using of the service.
